COPD Hotline Tester Terms of Use

Participation, service limits and separate consent choices for invited hotline testing with Respiplus.

Policies & contents

1. The service

PhoenixCare Inc. provides this invited educational pilot with Respiplus. You will speak with an artificial-intelligence assistant providing general information about COPD. It is being evaluated and may give incorrect, incomplete or unsuitable answers. These Terms apply to invited testing, not the public marketing website. A separate clinical or research program requires its own arrangements. These Terms and the companion Tester Privacy Notice do not amend a signed pilot agreement or authorize clinical monitoring or research.

2. Medical and emergency limits

The hotline does not provide medical care, diagnosis, interpretation of test results, personalized medical advice or medication/treatment changes. Using it does not create a healthcare-professional relationship. Follow your existing care plan and ask your healthcare professional about personal medical decisions.

In an emergency, hang up and call 911. The hotline does not dispatch emergency services or provide continuous clinical monitoring. A safety alert or later clinical review does not guarantee an immediate response or clinician callback.

3. Participation and availability

Participation is voluntary. You may stop a call or withdraw from testing without affecting your usual care. Use the number and arrangements confirmed by your pilot coordinator. The planned tester window is 9:00 a.m. to 5:00 p.m. Eastern Time. Availability may be interrupted; this pilot does not promise round-the-clock access or continuous clinical supervision.

4. Recording and personal information

The pilot processes your call audio and transcript, call details, consent records and health information you choose to discuss to provide the service and maintain quality, safety and an auditable record. Optional feedback is evaluated separately, and improvement uses aggregated feedback themes. Access is limited to authorized PhoenixCare and Respiplus coordination, technical and safety-review roles and, where applicable to your separately explained program, participating clinic personnel. Technology providers support the service, including processing in the United States.

The companion Tester Privacy Notice v2.0 explains information use, recipients, retention, safeguards, material risks and your rights. Read it, or ask for an oral explanation, before your first test call. Accepting these Terms does not itself give privacy consent. This tester consent design requires express consent to the explained core processing and an affirmative recording/transcription confirmation at each call. If you decline or withdraw required call processing, the recorded service cannot continue. Stopping a call does not automatically erase records already collected.

Future caller recognition and retention of health-related conversation memory are separate optional choices. Declining either does not prevent the current recorded call. Feedback questions and requested follow-up are also optional. Do not provide another person’s confidential information without authority, or send medical details through ordinary email or the public website form.

5. Feedback and other uses

You may choose whether to give feedback. PhoenixCare may analyse that feedback for the disclosed pilot evaluation and use aggregated themes to improve the service. These Terms do not authorize identifiable testimonials, unrelated marketing, research or training general-purpose AI models on identifiable call content. Additional uses must be permitted by the privacy assessment and applicable agreements, supported by a lawful basis and, where required, separate informed consent. Future research requires separate research arrangements, applicable ethics approvals and research consent.

6. Responsible use and changes

Use the hotline only for the invited test and follow the coordinator’s instructions. Do not impersonate others, disclose information you are not entitled to share, disrupt the service or attempt unauthorized access. PhoenixCare may pause access or the pilot to address safety, privacy, technical problems or misuse. Material changes to the terms or data practices will be explained before they apply; renewed agreement or consent will be obtained where required.

7. Your rights and contact

These Terms do not waive your privacy rights or other protections under applicable law, or exclude liability that cannot lawfully be excluded. You may request access, correction, withdrawal of consent or deletion where applicable; stopping participation does not automatically delete records already lawfully retained.
